We do not provide service content (e.g., website files, databases) via physical media such as CDs, USB drives, or other devices to avoid technical issues and unauthorized use. All deliverables are provided through secure digital channels.

Client Responsibility

You are responsible for maintaining accurate payment information and ensuring timely payments. Non-payment may result in:

• Payment: Payments must be made to "Innovative Digital Marketing" via standard methods. We do not authorize third-party payment collection.
• Non-Payment:
  • 7 days overdue: Technical support is suspended.
  • 14 days overdue: Services and website access are suspended.
  • 30 days overdue: All data, websites, and accounts are deleted.
  • Chargebacks result in immediate account termination and data deletion.
• Administrative Fees: Account reactivation incurs a INR 5,000 fee.

Prohibited Activities

• Illegal Use: Using our services for illegal activities, copyright infringement, or harmful content (e.g., pornography) is strictly prohibited.
• Spam Policy: Unsolicited commercial emails (UCE) or spam are forbidden. Violations result in:
  • First offense: INR 7,500 penalty and account termination
  • Second offense: INR 10,000 penalty and immediate termination.
  • System Abuse: Prohibited actions include introducing malware, unauthorized server access, network monitoring, or resource-intensive scripts. Violations may lead to civil or criminal action.

Prohibited Scripts and Software

• Restricted Scripts: Resource-heavy scripts (e.g., chat rooms, IRC bots, proxy servers) are not allowed.
• Third-Party Software: Installing third-party CMS or plugins (e.g., WordPress, Magento) is prohibited and may result in account suspension.

Intellectual Property and Ownership

• You Own: Upon full payment, you own HTML/CSS/JavaScript, visual design, and text content you authored.
• You Don’t Own: Domain name, web server, CMS, database software, or source code. We provide a license to use these while hosted on our servers.
• Restrictions: We do not share CMS, source code, database files, or hosting credentials. Domain control panel access may be granted upon written request, with you assuming responsibility for any issues.

Data and Backups

• Your Responsibility: You must maintain backups of your data. We are not liable for data loss.
• Backups: We take weekly backups for server restoration, but we do not guarantee data recovery.

Limitation of Liability

We are not liable for:

• Data loss, system downtime, or service interruptions.
• Incidental or consequential damages from service use.
• Losses from website performance or service outcomes.
• Errors in content or services.

Governing Law

These terms are governed by Indian laws, with disputes subject to the exclusive jurisdiction of Delhi courts.

Changes to Terms

We may modify these terms without notice. Changes are effective upon posting. Review periodically for updates.
